Terms of Service

Gensparkly provides on-demand GPU compute, reserved clusters, storage, and related managed services as described on our website and in individual order forms.

Customer is responsible for (a) all use of the Services under its account, (b) compliance with applicable laws, and (c) the security of its credentials and content.

Customer will not use the Services to violate law, infringe third-party rights, or degrade the Services. Full policy at https://gensparkly.com/legal.

Fees are as set out in the applicable order form or on the pricing page. Amounts are due per the billing cycle. Late payments accrue interest as permitted by law.

These Terms remain in effect while Customer uses the Services. Either party may terminate for material breach not cured within 30 days of written notice.

Each party will protect the other's confidential information using at least the same degree of care it uses for its own confidential information.

Except as expressly stated, the Services are provided "as is" without warranties of any kind, to the maximum extent permitted by law.

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages. Aggregate liability is capped at the fees paid in the 12 months preceding the claim.

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of New Delhi.
